Animal law in Germany | German and cross-border matters

horak Rechtsanwälte advises animal owners, breeders, equestrian businesses, veterinary practices, shelters and organisations on German animal law and cross-border matters involving Germany.

Horses, breeding and animal sales

We review sale, breeding, boarding and training agreements, veterinary examination records and disputes concerning defects or agreed characteristics. In cross-border transactions, jurisdiction and applicable law should be assessed before proceedings are started.

Veterinary practices and animal businesses

Our work includes veterinary liability disputes, fees, business agreements and regulatory issues. We assess the documents and the relevant professional rules before recommending a course of action.

Administrative proceedings and urgent relief

Orders concerning animal keeping, removal of animals, licences and operating conditions may require action within a short period. An objection or court action does not always suspend enforcement. Please send the complete decision and the date it was served.

Criminal defence and administrative fines

We advise on allegations relating to animal welfare and on related criminal or administrative-offence proceedings. Access to the case file and veterinary evidence are central to preparing the defence. Separate regulatory proceedings may continue at the same time.

Working with us

Advice can be arranged remotely. For foreign law and proceedings requiring local admission, the involvement of appropriately qualified counsel is assessed. Please identify the countries involved, the parties, the animal and any deadline. Acceptance of instructions is subject to a conflict check and agreement on scope and fees.

Feed, veterinary medicines and veterinary products

We advise manufacturers, importers, distributors and veterinary businesses on product classification, market access, labelling, advertising, supply agreements and liability under German and applicable EU law. Cross-border projects require a separate assessment of each target market.

Veterinary products must not automatically be treated as human medical devices under the MDR. The German Veterinary Medicinal Products Act contains specific rules for certain veterinary technical products; other technical safety requirements may apply depending on the product.
